Confused about the legal maneuverings surrounding the APR case? Here is what our attorneys Doug Meiklejohn and Jaimie Park say:

1 Judge Reynolds issued a Memorandum Decision on Motions for Summary Judgment on July 24

2 Judge Reynolds requested that Community Protestants and Catron County submit a proposed final order by August 15

3 He requested that if any party disagrees with the proposed final order they must submit their own proposed order by August 20

The Judge can select an order or he can write his own. There is no deadline for the Judge

Once the Judge issues an order the APR will have 30 days to file an appeal to the Court of Appeals, if they choose to do so

It is still a bit up in the air when it comes to knowing for sure what will happen when, and no one is predicting what the Judge or what APR will do. After 12 years, we can wait a little while longer.

Note: A court order is an official proclamation by a judge that defines the legal relationships between the parties to a hearing, a trial, an appeal or other court proceedings. A final order concludes the court actions.

As of today, Judge Reynolds has not rendered a decision about the Augustin Plans Ranch application to mine water in the Plains of San Augustin basin. I’ll stay on top of things and let you know his decision as soon as it’s available.

APR HEARING JULY 26, 2019

Presiding over a packed courtroom, Judge Matthew Reynolds heard arguments on June 26 relating to the Augustin Plains Ranch LLC’s (APR) application to mine water in the Plains of San Augustin basin. Judge Reynolds has said he will have a decision on the case by the end of July.

The issue is that of summary judgment, that is, the application should be dismissed as it doesn’t meet statutory requirements. The APR is arguing that it deserves an evidentiary hearing on the application, to be held in two stages: stage one to discuss hydrology, stage two to show beneficial use. How APR will meet the requirements of beneficial use for the water they are applying for is not clear. This water battle has been going on for 12 years and attorneys arguing for the protestants made a point of that, suggesting that repeated hearings on the same application should not be allowed.

The Judge has limited the four parties: Protestants, Catron County, APR and OSE to a total of 25 minutes to present protestants arguments. Protestants representative may only reserve up to 5 minutes out of the 25 minutes for rebuttal. Order of argument: APR, OSE, "Us", Catron County. OSE will not have the final word.

Those of you opposed to the water grab attempt on the Augustin Plains, but not represented by an attorney, might like to know that there is a lot of legal activity surrounding the case. All motions are now filed, the Judge has them all, and he will be up to speed at the hearing.

The good news is the number of Joiners in the case, that is, those who have filed motions supporting the opposition to this water grab attempt. Those joining the protest (meaning the filings by the New Mexico Environmental Law Center) are The Pueblos of Isle ta, Sandia and Santa Ana; the San Augustin Water Coalition; WildEarth Guardians; the County of Socorro; the Pecos Valley Artesian Conservancy District; the Navajo Nation (partial joinder); and the Hand Living Trust.

Don't forget the hearing on June 26: 10:30 am, Reserve Court House.

This meeting will allow SEC ratepayers and other stakeholders to comment on SEC’s pending rate case and ask questions.

The format of the public comment meeting will be as follows:
1. SEC will give a short 5-10 minute presentation on its rate case filing.
2. PRC Hearing Examiner Carolyn R. Glick will permit questions from the audience to SEC about its rate case filing.
3. Public comment not to exceed 5 minutes per person.

May 17, 2019 - APR Update
Motions in Response to various motions for Summary Judgment have been filed in the Augustin Plains case – four of them. Admittedly, although I am reading the motions, I don’t know all the legal ins-and-outs, so I won’t attempt to summarize these new motions. What I will do is inform you that the New Mexico Environmental Law Center has spent many hours on our behalf to refute the claims of the Augustin Plains Ranch LLC (APR) that they deserve an “evidentiary hearing”. Others filing similar documents add to and complement the NMELC arguments against the APR’s claim.

Remember that the Motions for Summary Judgment request the Court deny the application because it lacks specificity, that it is speculative.

From the Catron County filing: “APR has failed to provide an actual, specific plan to use water in a specific amount, for a specific purpose, at a specific location.” ... “The Court also held that ‘not only does the underground water permitting statute require specificity, the constitutional mandate of beneficial use as the basis of a water right requires specificity of the actual place and use of water, along with all the other definite elements required to create a right’.” These two statements support the argument that the APR application should be denied, and that a request for an evidentiary hearing is also denied.

I am puzzled that the judge in this case has allowed this request to go forward. Why did he want to hear arguments about an evidentiary hearing when this is an obviously speculative application? What APR wants is a two-stage hearing, the first on the hydrology of the Plains basin, the second scheduled so as to allow them time to come up with contracts to sell water. They’ve already had 12 years to do that, and they have not succeeded!

A reminder: don’t forget the hearing on June 26 in Reserve at the Courthouse, 10:30am. Your presence is essential and much appreciated.
